These Terms of Use (“Terms”) govern your use of harshtruths (the “App”), operated by Harshtruths.app (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The service
harshtruths delivers a daily reflection drawn from public‑domain Stoic writing and original material, an optional personality quiz, a private space to write your own reflections, and optional daily reminders. Some features are available only with a paid subscription (“harshtruths +”).
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App.
3. Subscriptions, billing, and cancellation
harshtruths + is an auto‑renewable subscription sold through the Apple App Store:
- Plans: Annual — $29.99/year (with a 7‑day free trial for new subscribers); Monthly — $4.99/month. Prices may vary by region and are shown in the App before purchase.
- Billing: Payment is charged to your Apple ID at confirmation of purchase.
- Free trial: If your plan includes a free trial, it automatically converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited if you purchase a subscription.
- Renewal: The subscription renews automatically unless auto‑renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
- Managing your subscription: You can manage or cancel in your Apple ID account settings after purchase. Deleting your data in the App does not cancel your subscription.
- Refunds: Purchases are handled by Apple and are subject to Apple’s refund policies. We do not process payments and cannot issue refunds directly.
4. Your content
Reflections and quiz answers you create remain yours. They are stored on your device and in your private iCloud (see our Privacy Policy); we do not access, host, or claim any rights to them.
5. Our content and licence
The App and its content (including original writing, design, and software) are owned by us or our licensors and are protected by law. Stoic quotations are drawn from public‑domain sources. We grant you a limited, personal, non‑transferable, non‑exclusive licence to use the App for your own personal, non‑commercial use, subject to these Terms and the App Store Terms of Service.
6. Acceptable use
You agree not to copy, resell, reverse‑engineer, or redistribute the App or its content, or use it in any unlawful way.
7. Not professional advice
harshtruths is intended for personal reflection and is provided for general informational purposes only. It is not medical, psychological, therapeutic, legal, or financial advice, and it is not a substitute for professional care. It is not a crisis or emergency service. If you are struggling with your mental health or in crisis, please contact a qualified professional or your local emergency services.
8. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, or that content will suit your circumstances.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of the App. Where liability cannot be excluded, our total liability is limited to the amount you paid for the App in the 12 months before the claim.
10. Changes
We may modify the App or these Terms from time to time. Material changes will be indicated by updating the “Last updated” date. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict‑of‑laws rules. Disputes will be subject to the courts of that jurisdiction.
12. Apple and the App Store
These Terms are between you and Harshtruths.app only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility. Apple is not responsible for addressing any claims relating to the App, including product‑liability, regulatory, or intellectual‑property claims. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist‑supporting,” and that you are not on any U.S. Government restricted‑parties list.
